Employment Tribunal Delays Leave Claimants in Limbo

In England and Wales, individuals filing unfair dismissal claims are facing unprecedented delays, with some cases not being heard for up to five years. This backlog, now nearly 72,000 claims deep, is causing significant distress for claimants who often find themselves without income during this prolonged wait.

One poignant example is Catriona Ball, who filed a claim following her husband’s death after he left a job he believed was harming his health. The emotional toll of navigating grief alongside legal uncertainty is compounded by the financial strain of potentially having to sell her home to fund the tribunal process.

Legal experts warn that these delays not only hinder justice for workers but also complicate matters for businesses defending against claims. Witnesses may no longer be available, and cases can be dismissed due to the inability to conduct fair trials.

The Employment Lawyers’ Association is calling for urgent reforms to address this crisis, highlighting that the current system is unsustainable and detrimental to both employees and employers. Without intervention, the situation is likely to worsen, leaving many in a state of legal limbo for years to come.
