Spain’s New Citizenship Law: A Historic Shift for Western Saharans

Spain’s parliament has approved a significant law granting citizenship to tens of thousands of Western Saharans born during its colonial rule. This legislation, which applies to those born before September 29, 1977, aims to rectify historical injustices by allowing Sahrawis and their descendants to claim Spanish nationality, even if they do not reside in Spain.

The law, which passed with 168 votes in favour, has sparked a complex diplomatic situation with Morocco, which has controlled Western Sahara since 1975. While the Spanish government has shifted its stance to support Morocco’s autonomy plan, this new citizenship law could strain relations further, as it highlights the unresolved status of the Sahrawi people and their quest for independence.

Beneficiaries will have three years to apply for nationality, significantly reducing the previous waiting period that could extend up to 24 years. This change not only impacts the lives of those eligible but also reflects a broader shift in Spain’s approach to its colonial past and its responsibilities towards former territories.

As Spain navigates its historical ties and current diplomatic relations, the implications of this law could resonate beyond citizenship, potentially influencing migration patterns and regional stability in North Africa. The situation remains dynamic, with both support and opposition emerging within Spain and Morocco regarding the law’s potential effects.
